HENRY CLARK, of the state and District aforesaid, being of sound and disposing mind and memory but weak in body and calling to mind the uncertainty of life and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with to make hand ordained this my last will in manner following, that is to say: I desire that the stock of all kinds, horses, cattle, hogs, and sheep, household and kitchen Furniture, Plantation tools, one set of blacksmith tools, one wagon, and ox cart be immediately sold after my decease and out of the money arising therefrom all my just debts and funeral expenses to be paid and should said property prove insufficient for the above purpose then I desire than my executor hereinafter named may sell [BLANK] and out of the monies arising therefrom pay and satisfy such of my just debts as shall remain unpaid out of the sales of [BLANK] after payment of my debts and funeral expenses. I give to MARTHA PRICE fifty dollars being the sum of money that I intended for her father SAMUEL CLARK. I give to my brother MOSES CLARK fifty dollars. I give to my brother LEWIS CLARK fifty dollars. I give to my brother JOSHUA CLARK fifty dollars. I give to my sister JANE WHITE fifty dollars. I give to my sister TABITHA BRYAN fifty dollars. I give to JAMES CLARK the tract of land where he now lives on with the exception of fifty dollars to each one of his brothers, AARON CLARK, fifty dollars to SIMON CLARK, fifty dollars to MOSES CLARK, fifty dollars out of the value of such land. I give to CULLEN CLARK one hundred acres of land in the corner joining Mrs. MAY and others. I give to MOURNING M. STEVENS a negro man by the name of GEORGE, one negro man by the name of DUDLEY, one negro woman by the name of ROSE, and her children, viz: SAMPSON, ALAN, PICKENS, and MILLEDGE. I also give to MOURNING M. STEVENS one negro woman by the name of LUCY for said MOURNING M. STEVENS to take charge of her own mother until her death. WILLIAM, ELIZA, MATILDA, and CLARISSA. All the rest of my estate both real and personal of what nature or quality soever, it may be not herein before particular disposed of, my desire may be equally divided between MORNING M. STEPHENS and HARDY WHITE and I give the same to them their heirs executors administrators and assigns forever. And lastly I constitute and appoint ELISHA STEVENS and HARDY WHITE executors of this my last will and testament by me heretofore made. WITT Page 3 of 9 ** PAGE BREAK ** Will, SC, Edgefield, HENRY CLARK 1840 South Carolina Edgefield District Personally appeared before me MICHAEL WITT who being duly sworn on the holy evangelists of almighty God and says he was present and saw HENRY CLARK sign, seal and acknowledged the foregoing instrument of writing to be and contain his last will and testament and that he the said HENRY CLARK was then of sound and disposing mind memory and understanding to the best of deponents knowledge and belief, and that he, MICHAEL WITT, together with JOHN GLAZE and JOHN M. WITT signed their names as witnesses thereto at the request of the testator and in his presence and in the presence of each other. Same time qualified ELISHA STEVENS and HARDY WHITE executors. TOWLES, OED Page 5 of 9 ** PAGE BREAK ** Will, SC, Edgefield, HENRY CLARK 1840 State of South Carolina Edgefield District In the matter of HENRY CLARK’s will ELISHA STEVENS and HARDY WHITE, executors of the last will of HENRY CLARK, deceased, having been cited upon the application of MOSES CLARK and JOSHUA CLARK some of the heirs at law of the said HENRY CLARK, to appear before me in the court of ordinary for the district and state aforesaid to prove the will of the HENRY CLARK in the solemn form of law. And the said parties, as well the said ELISHA STEVENS and HARDY WHITE as the said applicants having appeared before me with their counsel and witnesses on Friday the 26th day of June 1840, also on Saturday the 27th day of June 1840, and after hearing the testimony of the two subscribing witnesses as to the execution of the said will and numerous other witnesses touching the capacity of the said HENRY CLARK I adjudge and decree that the paper in question is the last will and testament of HENRY CLARK and I have admitted the same to probate in solemn form of law this 21st day of July 1840.
