Will, DE, Sussex, John Cirwithin 1777

In the name of God Amen.

I JOHN CIRWITHIN of Prime Hook Neck being sick and weak but of sound and perfect
memory thanks be to Almighty God there for, do make & ordain this my last will and
testament in Manor following viz.

FIRST I BEQUEATH my soul to the hands of God trusting by the merits of my redeemer
to inherit eternal life.

ITEM I GIVE AND BEQUEATH to my well-beloved wife NANCY CIRWITHIN, one third part of
all my movable estate and lands. And, if in case my well-beloved wife NANCY
CIRWITHIN should die, she shall have no power, thereto, by bond nor of a deed. And
I give also to my well-beloved wife NANCY CIRWITHIN my black horse and money enough
out of my estate to buy her a saddle.

And the rest of my movable estate which it pleased God to bless me with of my one
property to be equally divided between my four daughters SARAH [CIRWITHIN], MARY
[CIRWITHIN], REBECCA [CIRWITHIN], BETTY [CIRWITHIN] and the one she goes with.

I GIVE AND BEQUEATH to my daughter MARTHA that part that her grandmother left her
by a deed of gift and one fifth part of her brother JOHN [CIRWITHIN] Legacy and 40
shillings of the residue of my own estate to be enjoyed by her, her heirs and
assigns forever.

And after this the residue of my estate to be equally divided between my wife and
four daughters, SARAH, MARY, REBECCA, BETTY and the one she goes with.

I do appoint my well-beloved wife NANCY CIRWITHIN and my beloved brother CALEB
[CIRWITHIN] my whole and sole executor of this my last will and testament hereby
revoking every will or bequeathed bequest heretofore made or caused to be made by
me, only acknowledging this to be my last will and testament.

As witness my hand and seal this 15th day of March 1777 year of Our Lord.

Memorandum

On the 15th day of May 1777, before me PHILLIPS KOLLOCK, register appointed for the
probate of wills and granting letters of administration for the county of Sussex on
Delaware, personally appeared [CHRIS NUTTER] and [JOHN NUTTER] two of the witnesses
to the within will subscribing and being duly sworn in the Holy evangelists of
almighty God did swear by deposition scratch severally depose and say that in their
sight, presents, and hearing the testator John score within did Signed, Sealed,
published, pronounce and declare that within to be his last will and testament and
that after doing their of he was of a sound mind, perfect and disposing mind,
memory, and judgment to the best of their knowledge and that they and each of them
together with [THOMAS COLLINGS] subscribed their names as witnesses to the
execution thereof, in the presents and at the request of the testator
