From the foregoing settlement there appears to be two hundred & seven dollars & 26/100 cents in the hands of ELIZA GABBIE, the administratrix of said estate, subject to distribution amongst the heirs at law of ROBERT GABBIE, deceased. It is therefore ordered & decreed that the said administratrix do pay over to the said heirs at law the sums following, viz: To JAMES H. OWENS and HILLY GARVIN are holden and firmly bound unto BENJAMIN CHAMBERS Esquire, ordinary for the District of York in the full and just sum of $1,000 lawful money of this state, to be paid to the said BENJAMIN CHAMBERS his successors, ordinaries of this District, or there certain attorney or a signs. To which payment well and truly to be made, we find ourselves, and every of us, our and every of our heirs, executors, and administrators, for the whole, and in the whole, jointly and severally, firmly by these presents. Seals with our seals, and dated the 31st day of October in the year of Our Lord 1825. THE CONDITION of the above obligation is such, that if the above bound ELIZA GABBIE administratrix of the goods, chattels, and credits of ROBERT GABBIE deceased, do make a true and perfect inventory of all and singular the goods, chattels, and credits of the said deceased, which have or shall come to the hands, possession or knowledge of the said ELIZA GABBIE or into the hands or possession of any other person or persons for her and the same so made, do exhibit into the said Court of ordinary, when she shall be thereunto required and such goods, chattels and credits do well and truly administer, according to law, and do make a just and true account of her acting's and doings there in when required by the said court, and all the rest of the said goods, chattels and credits which shall be found remaining upon the account of the said Administration, the same being first allowed by the said court, shall deliver and pay on to such persons respectively, are entitled to the Same by law: and if it shall hereafter appear that any last will and testament was made by the said deceased, and the same be proved in court, and the executives obtain a certificate of the probate thereof, and the said ELIZA GABBIE do in such case, if required, render and deliver up the said letters of administration, then this obligation to be void, or else to remain in full force. These are to authorize and empower you, or any three or four of you, whose names are hereunder written to repair to all such parts and places within the state as you shall be directed unto by ELIZA GABBIE administratrix of the goods and chattels, rights and credits of ROBERT GABBIE late of said District, deceased, wheresoever any of the goods and chattels are or do remain within the said parts and places, and which shall be shown on to you by the said ELIZA GABBIE, and there view and appraised all and every of the said goods and chattels, first being duly sworn on the Holy Evangelists of Almighty God, to make a true and perfect inventory and appraisement thereof and to cause the same to be returned under your hands, or any three or four of you, unto the said ELIZA GABBIE on or before the 25th day of December next. Memorandum, that on the 15th day of November in the year of Our Lord 1825 personally appeared before me BENJAMIN CHAMBERS one of the justices assigned to keep the peace in York District JOHN MILLER, GEORGE DAVIS and WALKER BENSON being three of the appraisers appointed to appraise the goods and chattels of ROBERT GABBIE, late of said District, deceased, who, being duly sworn, made of, that they would make a just and true appraisement of all and singular, the goods and chattels of the said ROBERT GABBIE deceased, as shall be produced by ELIZA GABBIE administratrix of the estate of the deceased, and that they would return the same, under their hands unto the said ELIZA GABBIE on or before the 20th day of December next. I Desiring that the goods, rights and credits of the said deceased, maybe well and truly administered, converted and disposed of, do hereby grant unto the said ELIZA GABBIE in whose fidelity, and in this behalf, I very much confide, full power by the tenor of these presents, to administer the goods, rights and credits of the said deceased, which to her in her lifetime, and at the time of her death, did belong; and to ask, levy, recover and receive the same, and to pay the debts in which the deceased stood obliged, so far forth as her goods, rights and credits will extend, according to their rate and order of law; being first sworn on the holy evangelists of almighty God, to make a true and perfect inventory thereof, and to exhibit the same into the ordinaries office, in Yorkville in order to be recorded, on or before the 30th day of December now next ensuing: and to render a just in true account, calculation and reckoning of the said administration, when thereunto required: and I ordain, depute and constitute you, the said ELIZA GABBIE administratrix of all and singular the goods, rights and credits of the said deceased. WHEREAS ELIZA GABBIE administratrix of the goods and chattels of ROBERT GABBIE deceased, have petition the court for liberty to sell the personal property of the set of State; and it appearing proper, upon do investigation, to Grant the prayer of the said petition: THESE ARE THERE FOR to permit and empower the said ELIZA GABBIE to expose to sale at public outcry, on the 15th and 16th day of November next at the late residence of JOSEPH GABBIE SENIOR deceased all the property of that estate, which may have come into her hands, to the highest bidder, on a credit 12 months for all sums above $2, taking bond with sufficient security; for $2, and also comes under cash on delivery 15 days previous notice to be given by public advertisement, and a return of the proceedings of said sale to be by her maid to the ordinaries office of four said, within the time prescribed by law. Whereas, ELIZA GABBIE has applied to me for letters of administration on all and singular, the goods and chattels, rights and credits of ROBERT GABBIE late of the district aforesaid, deceased. These are therefore to cite and admonish all and singular, the kindred and creditors of the said the deceased, to appear before me, at our next ordinaries court for the said district to be holding at York courthouse on the 31st day of October next to show cause if any, why Administration should not be granted.
