ROSS, OYD The petition of ALLEN ROBISON shows that JAMES ROBISON deceased died intestate seized and possessed of, in fee simple, a tract of land lying in York District on the Waters of ALLISON's Creek bounding on the lands of A. D. HARVEY, FRANCIS ARMSTRONG, JOHN WALKER and LEANDER PACKARD containing 158 Acres more or less. THAT at the time of his death he left the following heirs at law viz: MARGARET ROBISON, his widow, and the following children DAVID ROBISON, WILLIAM GARDNER and wife ESTHER [ROBISON], ALLEN ROBISON, JAMES ROBISON, JANE ROBISON, ROBERT ROBISON and the following children of his deceased son JOHN ROBISON viz: WILLIAM YOUNGBLOOD and wife CLEMENTINE, LOUISA ROBISON, JAMES M. ROBISON, LARKIN ROBISON and PENENA ROBISON the last named two of whom are miners and the following children of his deceased daughter GRIZZELLA LYNN viz: WILLIAM JACKSON and wife MARGARET, MARTHA WHITAKER a minor. THAT DAVID ROBISON and JAMES ROBISON reside without the state. YOUR petitioner further shows that he is desirous that partition thereof be made. He therefore prays you institute proceedings thereof. ROSS, ordinary of York district and his successors and office in the sum of $500 good and lawful money of the state of South Carolina to be paid to the said JOHN M. ROSS ordinary or his successors aforesaid to which payment will and truly to be made and done we find ourselves each and every of us our Executives and administrators jointly and severally firmly by these presents sealed with our seals and dated this 10th day of February ad 1855. THE CONDITION of the above obligation is such that if the above bound ALFRED GARDNER shall and do will and truly pay or cause to be paid unto the said JOHN M. ROSS, OYD THE petition of GEORGE STEELE show us that he is a creditor JAMES ROBISON deceased by sealed note that the assets in the hands of JOHN H. ADAMS are altogether insufficient for the payment of the debts of deceased that the land of deceased has been sold for partition and division your petitioner there for praise that the sale of the real estate may be paid over to said administrator to be applied to the payment of this debt of deceased. October 15th 1857 GEORGE STEELE, Sr. South Carolina York District JOHN H. ADAMS administrator of JAMES ROBISON deceased having appeared on accounting there being no personal estate and remaining unpaid of preferred claims and sealed notes $273.21 at is hereby decreed that the whole of the funds arising from the sale of the real estate amounting to $227.42 be paid over to said administrator on his complying with the requisition of the Act of Assembly in such case made and provided. Summons in Partition On due examination it is ordered and decreed that the lands described in the summons in Partition and this case represented by the plaintiff marked (B) made by JOHN DENNIS, December 27th 1854, bounding the lands of MARGARET ROBISON, LEANDER PACKARD and JOHN WALKER containing 101½ acres more or less be sold by the sheriff of York District on the first Monday in February next or on such other sales day as we'll be more advantageous for the parties and interest on a credit of one and two years with interest the purchase giving Bond purchaser giving bond with good security and a mortgage of the premises if needed necessary to the ordinary for the payment of the purchase money sufficient cash to pay costs.
