Probate, NC, Craven, MARY WITHERSPOON 1805 State of North Carolina New Bern District In obedience to an order of the superior court of law for the District of New Bern made at term 1805 appointing the under a signed Commissioners to divide and appropriate among the heirs of this is MARY WITHERSPOON divided the lands of which said deceased died seized, possessed or entitled to. We have divided, allotted, and appropriated the same as follows, viz. To Miss ANN NASH the Pembroke Plantation with all the lands of the said MARY WITHERSPOON adjoining thereto, situate in Craven County, Bounded as follows. On the N by Trent River on the E by BRICE’s Creek, on the W by HOOD’s Creek, and on the S by the lands of DURANT HATCH and FREDERICK FOY containing 644 Acres, more or less. And estimated this share as of inferior value to the other share hereby allotted, we do charge the said remaining share with the sum of £500 to be paid by the proprietors of them, equally to the said ANN NASH. To Mrs. ELIZABETH S. OGDEN a tract containing 1060 acres called Seven Springs tract, situated in Jones County, bounded and described as follows. Beginning at an Ash in the river swamp, near the upper end of the great Marsh running thence S 13½ E to the back line of a patent granted to FREDERICK JONES, called South Wales; thence with said line S 80 E to a corner of said patent; thence with said patent N 10 E 240 poles to Reedy branch; thence down Reedy branch to FREDERICK FOY’s line of his 250 acre tract; thence with the courses and lines of his said tract S 82 W 122 poles, N 8 W 300 poles and N 82 E to Reedy branch; thence down Reedy branch to Trent River and up the run to the beginning. To Miss MARIA NASH, a tract containing 986 Acres. Being at the mouth of Miery Hole Branch on the lower side thereof, running fence South 27 and 1/2 East to the public road, JOSEPH SANDERSON's line; thence with the same eastwardly to SANDERSON's corner; thence with his line S to the back line of the South Wales patent; thence along that line S 80 E to ELIZABETH S. OGDEN's line; thence with her line N 13½ W to Trent River, and up the river to the beginning. Lying in Jones County. JOHN WITHERSPOON, a tract containing 985 Acres situated in Jones County. Beginning at a maple on the S Bank of Trent River, below the mouth of Island Creek and below the old ship landing running thence S 11 E 416 poles more or less to a Poplar, at the Lower Side of the mouth of Ham Branch; thence of the east side of Island Creek to the public road, JOSEPH SANDERSON's line; thence eastwardly along SANDERSON's line to MARIA NASH's line; thence with her Line N 27½ W to Trent River and up the river to the beginning. Beginning at a maple upon the south bank of Trent River, JOHN WITHERSPOON's beginning, below the mouth of Island Creek and below The old ship Landing, running thence with his Line S 16 E 416 poles, more or less, to a Poplar on the riverside to the mouth of Ham Branch, JOHN WITHERSPOON's Corner; thence up the east side of Island Creek to the back line of a patent of 1,450 granted to FREDERICK JONES 20th of March 1711 / 1712 which said back line is described in said grant to run from a Pine at the head of MANSFIELD's Brook or Creek E 1,180 poles to a Pine by the side of a pond; thence along and with the said back line W 350 poles, more or less, to EDMUND HATCH’s corner; thence with HATCH’s line N 380 poles to a water Oak in a pond, his corner; thence with another of HATCH’s lines N ??? W 128 poles to his corner; thence with HATCH’s line N 14 W 82 poles to a Hickory, HATCH’s corner, and JOHN STANLEY's beginning of his 500 acre tract HATCH’s with said STANLEY's line N 26 W to Trent River, and down river including the island at the mouth of Island Creek to the beginning. The petition of ANN NASH, ELIZABETH NASH, and of FREDERICK NASH, FRANCIS NASH's and MARIA NASH, infants under 21 years by BENJAMIN WOODS their Guardian for this special purpose, duly appointed, and of JOHN WITHERSPOON an infant under 21 years, by JOHN C. OSBORNE his guardian. Which said ANN, ELIZABETH, FREDERICK, FRANCIS, MARIA and JOHN are children and heirs at large of MARY WITHERSPOON, deceased, late the wife of DAVID WITHERSPOON, also deceased. Humbly show on to your honors your petitioners that the hold together as tenants- in-common sundry plantations and tracts of land lying in the County's of Craven and Jones which they have lately inherited from their said mother as heirs at law. And your petitioners are desirous of having partition made between them of the said plantations and tracts of land so that they made hold and enjoy their respective shares or parts in severalty. May it please your honors, therefore, to appoint five distinct persons to make equal partition and ??? your petitioners of the set plantations and lands according to the directions and acts of assembly and such case made and provided.
