Deed, MD, Prince Georges, WILLIAM BRIAN 1761

At the request of WILLIAM BRIAN the following deed was recorded November 10th 1761.

This indenture made the twentieth day of October in the year of our Lord one
thousand seven hundred & sixty one between WILLIAM THOMAS of Frederick County in
the province of Maryland of the one part and WILLIAM BRIAN of Prince Georges County
in said province of the other part.

Witnesseth that the said WILLIAM THOMAS for and in consideration of the sum of
eighty five pounds current money to him in hand paid before the sealing and deliver
of the presents the receipt whereof he doth hereby acknowledge hath bargained,
sold, alien, confirm and made over and by these presents doth bargain, sell, alien,
confirm and make over unto the said WILLIAM BRIAN his heirs and assigns forever all
that part or tract of land called the Mistake lying in Prince Georges County.

Beginning at a banded Black Gum Tree of Sister’s Delight and the beginning of
Brother’s delight … one hundred and seventy six acres, more or less, with all and
singular the premises and appurtenances as to … WILLIAM BRIAN his heirs and assigns
forever and the said WILLIAM THOMAS for himself his heirs and assigns covenants and
… the said WILLIAM BRIAN his heirs and assigns the said land and premises against
him, the said WILLIAM THOMAS and his heirs and all other persons whatsoever shall
and well warrant and forever defend by these presents and lastly the said WILLIAM
THOMAS for himself and his heirs doth covenant and … with the said WILLIAM BRIAN
his heirs and assigns that he, the said WILLIAM THOMAS and his heirs, shall and
will at any time hereafter at the request of and at the and at the proper cost … in
the law of the said WILLIAM BRIAN his heirs or assigns make any further deed or
writing for the … making over of the aforesaid land and premises unto him the said
WILLIAM BRIAN his heirs and assigns.

seal the day and year first above written.

pounds.

Then came WILLIAM THOMAS Sr. before me the subscriber one of his Lordship’s
Justices of the Provincial Court of Maryland and acknowledged all his right, title,
and interest of and to the said land & premises to WILLIAM BRIAN his heirs and
assigns and at the same time came ELIZABETH the wife of the said WILLIAM THOMAS who
being privately examined out the the hearing of the said husband relinquished all
her right, title of dower of and to the aforesaid land & premises to the said
WILLIAM BRIAN & that she was not induced thereto by fear or threats of or ill usage
from her said husband.

1761 November 10th Received seven shillings and a half penny sterling for an
alienation fine on the with one hundred & seventy six acres of land by order of …
