To make a true & perfect inventory & appraisement thereof, and to cause the same to be returned under your hands or any three or more of you to the said administrators on or before thte 14th day of September now next ensuing. The humble petition of MARGARET RAINEY showeth, That ROBERT PATTON is justly indebted to your petitioner the sum of thirty five dollars and fifty cents by note of hand with interest thereon and delays payment. THEREFORE your petitioner prays that the said ROBERT may be ordered, either personally or by his attorney, to be appear at the Court of Common Pleas, to be holden at York Court House for York District, on the fourth Monday in October next, that your Honors may then and there take your petitioner’s case into consideration, and grant such relief in the premises as, from the circumstances of the case, to your Honors shall seem meet. And your Petitioner will pray, WILLIAM SMITH, Pes. Pcl. Ordered, that the said ROBERT do appear at the time and place above mentioned, to answer to the aforesaid complaint: And that he do file his defense with the Clerk of the said Court, on or before the meeting of the same, and give reasonable notice to the plaintiff or his attorney, or judgment will be given against the said ROBERT by default. Also, ordered, that the Sheriff of the said District do serve this process and return it to the said Clerk, fifteen days next before the sitting of the said court. WITNESS the Honorable JOHN FAUCHERAUD GRIMKE, Esquire, Senior Associate Judge of the said state, at York Court House the second Monday after the fourth Monday in March in the Year of our Lord one thousand eight hundred and five and in the twenty ninth year of the Sovereignty and Independence of the United States of America. WILLIAM SMITH Plaintiff’s Attorney Page 4 of 7 ** PAGE BREAK ** Probate, SC, York, John Patton 1789 KNOW ALL MEN BY THESE PRESENTS that we JOHN PATTON JUNR., DAVID PATTON, ALEXANDER MCWHORTER, and JAMES MARTIN of York County and state of South Carolina are held and firmly bound to MALCOLM HENRY, WILLIAM BRATTON, JOHN GILLIAM, JOHN GARRISON, JAMES WILSON, and JOSEPH PALMER justices of the county court of York aforesaid in the penal sum of four hundred pounds lawful money of the state aforesaid for the true payment whereof we bind ourselves, our heirs, executors and administrators firmly by these presents sealed with our seals and dated this 14th day of July 1789. THE CONDITION OF THE ABOVE is that if the above bounden JOHN PATTON JUNR. and DAVID PATTON administrators of all the goods chattels and credits of JOHN PATTON deceased to make or cause to be made a true and perfect inventory of all and singular the goods chattels and credits of the said deceased which have or shall come to the hands possession or knowledge of the said JOHN PATTON JUNR. and DAVID PATTON or into the hands of any other person or persons for them and the same so made do exhibit or cause to be exhibited into the county court of York at such time as they shall be there unto required by the said court and all the rest and residue of the said goods chattels and credits which shall be found remaining upon the said administrators account the same being first examined and Allowed by the justices of the said Court for the time being shall pay and deliver on to such person or persons respectively as the said justices by their order or judgment shall direct pursuant to the laws in that case made and provided and if it shall here after appear that any last will and testament was made by the deceased and the executor or executors there in named do exhibit the same into the said Court making request to have it allowed and approved accordingly if the said JOHN PATTON JUNR. and DAVID PATTON being there on to required do render and deliver up their letters of administration approbation of such Testament being first had and made in said Court than this obligation to avoid otherwise true remain in full force and virtue.
