Probate, NC, Craven, Hardy Bryan, 1796 State of North Carolina Craven County Know all men by these presents that we FREDERICK LANE, THOMAS A. GREEN and JOSEPH LOFTIN all of Craven County are held firmly bound and firmly bound unto the representatives of HARDY BRYAN deceased in the full and just sum of eleven hundred and twenty five pounds sixteen shillings and six pence to be paid to the representatives, their heirs, executors, administrators or assigns to the which payment will and truly to be made and done we bind ourselves our heirs, executors and administrators jointly and severally firmly by these presents sealed with our seals and dated this 10th day of May A. D. 1796. The condition of the above obligation is such, whereas a judgment hath lately in the county court of pleas and quarter sessions held for Craven County, then obtained by the representatives of HARDY BRYAN deceased against the aforesaid FREDERICK LANE and LEWIS BRYAN executors of WILLIAM BRYAN deceased who was executor of HARDY BRYAN deceased for the sum of five hundred and sixty two pounds eighteen shillings and three pence, together with cost of said suit and the aforesaid FREDERICK LANE being dissatisfied therewith hath prayed for and obtained a writ of error to the superior court of law to be held for the district of Newbern on the 19th day of September next. Now in case the said FREDERICK LANE does present his said writ of error with affect and perform the Judgment sentence and decree, which the said superior court of law shall pass or make thereon, in case the same shall be decided against him and we well and truly perform the same agreeable to law than the above obligation to be void otherwise to remain in full force and virtue. Ordered that WILLIAM HENRY, WILLIAM COX, and GEORGE LANE audit the accounts of WILLIAM BRYAN deceased who was executor of HARDY BRYAN deceased and make return to the next term. Page 3 of 6 ** PAGE BREAK ** Probate, NC, Craven, Hardy Bryan, 1796 March term 1795 The referees appointed to audit the accounts of WILLIAM BRYAN deceased who was executor of HARDY BRYAN deceased made a return of the accounts by them settled, which is ordered to be filed on motion leave to accepted & c. Rule and enlarged till next term. Report of the referees as follows Agreeable to an order of the county court of Craven to us directed. We the subscribers have proceeded to examine the accounts of WILLIAM BRYAN deceased as executor of HARDY BRYAN deceased and do find the same as herein stated, that the balance due on the general account settled up to the 15th day of October 1790 to be four hundred and eighty five pounds two shillings and five pence. We also find a credit on the books of the said WILLIAM BRYAN for beef cattle belonging to JAMES BRYAN son of the aforesaid HARDY BRYAN deceased amounting to seventeen pounds ten shillings, and to WILLIAM BRYAN son of said HARDY BRYAN deceased for cattle sold to amount of thirteen pounds nine shillings and four pence. Also for one years hire of Negroes after the division which took place 13th of October 1790 belonging to ASA BRYAN to amount of sixteen pounds fifteen shillings and belonging to EDMUND BRYAN the amount of thirty six pounds four shillings. Given under our hands this 2nd day of January 1795. HARRIS Esquire for judgment final, pursuant to settlement of arbitrators, return to last term continued until next term. September term 1795 The foregoing award returned by WILLIAM HENRY and GEORGE LANE is received and approved of by the court accept as to seven pounds and two shillings and sixpence to be deducted out of the general account ordered that the executor pay the balance to those entitled. December term 1795 The representatives of HARDY BRYAN deceased vs FREDERICK LANE and LEWIS BRYAN executors of WILLIAM BRYAN who was EXECUTOR of HARDY BRYAN deceased Ordered that execution issue upon the Judgment of the Court given on the award returned by the referees in the above suit agreeable to the Judgment of the Court fieri fascias issued and not returned. March term 1796 The representatives of HARDY BRYAN deceased vs Executor of WILLIAM BRYAN deceased Motion for writ of error and allowed upon FREDERICK LANE the defendant entering into bond in the sum of eleven hundred and twenty five pounds sixteen shillings and six pence with JOSEPH LOFTIN and THOMAS A.
